Terms of Service
Last updated: 6 September 2026
These operational terms describe the current NexFlowsTech Paid Lead-to-Booking System and 30-Day Enquiry & Quote Recovery service. They are website copy, not legal advice. The agreed proposal or contract for a specific engagement controls if it contains different written terms.
1. Current service scope
The standard Paid Lead-to-Booking System is a bounded 90-day pilot that may include one selected Google or Meta advertising channel, campaign tracking, a focused landing or lead-capture path, qualification logic, suitable-prospect booking access, confirmation and reminders, a client-controlled CRM or lightweight pipeline, reporting definitions, optimisation, training, and handover. A second channel requires explicit written scope. The exact deliverables, dates, dependencies, and acceptance checks are stated in the proposal.
The 30-Day Enquiry & Quote Recovery service is a separate, bounded campaign for an agreed set of suitable existing enquiries or quotations. It may include record review, contact eligibility checks, approved follow-ups through an existing business channel, reply handoff, and a progress report. It does not include a new acquisition campaign, CRM migration, or outsourced closing. Final record limits, channel, follow-up count, pricing, and dates are stated in the proposal.
Previous CRM setup capabilities are delivery components inside these services. They are not separate headline packages under these terms.
2. Scope boundaries
The standard Paid Lead-to-Booking System covers leads entering through the campaign and landing-page funnel NexFlowsTech manages. The recovery service covers only the agreed existing records and channel. Neither service provides an omnichannel inbox or promises immediate handling across every existing WhatsApp, Instagram, phone, marketplace, or unconnected form. A suitable managed-funnel prospect may be qualified and routed to booking without waiting for a person to reply; a recovery reply is routed to the client owner for handling.
3. Client responsibilities
The client supplies accurate service, pricing, geography, capacity, qualification, availability, legal, brand, record, and contact-eligibility information; provides timely access and decisions; protects appointment capacity; conducts consultations and site visits; prepares quotations and proposals; handles replies, closing, and service delivery; and records attendance, proposal status, follow-up progress, and won or lost outcomes.
The client is responsible for lawful advertising, customer notices and consent, the accuracy of claims, the approved contact channel, and the lawful handling of customer information inside client-controlled accounts.
4. Media spend, subscriptions, and platform dependency
The client pays the agreed Google or Meta media spend and third-party software subscriptions directly. Calendar, CRM, advertising, analytics, hosting, and other platform capabilities are subject to provider availability, policies, pricing, limits, outages, and account status. NexFlowsTech cannot guarantee a third-party platform will remain available or behave outside its documented capabilities.
5. Measurement and no performance guarantee
The program separates qualified, booked, attended, proposed, won, and lost stages so the parties can review the pilot responsibly. Measurement is limited by data quality, attribution rules, client updates, market conditions, offer, pricing, capacity, sales conversations, and platform reporting. NexFlowsTech does not guarantee rankings, traffic, lead volume, cost per lead, qualified appointments, attendance, revenue, profit, or any other commercial result.
6. Payment
- Prices are in Malaysian Ringgit unless the proposal states otherwise.
- Setup, management, and any additional work are billed according to the agreed proposal.
- Work may pause when payment, access, approvals, or required information is overdue.
- Third-party charges are separate from NexFlowsTech fees.
7. Delivery dependencies and changes
Delivery begins after the agreed onboarding inputs, payment, access, decisions, and scope approval are available. Delays caused by missing information, account restrictions, platform changes, client review delays, or other dependencies extend the timeline. Work outside the agreed scope requires written approval and may change the fee or schedule.
8. Ownership and access
Where practical, configurations are made in client-controlled accounts. The client retains its business and customer data and receives access to delivered configuration. Third-party software remains subject to its provider's licence. NexFlowsTech retains its pre-existing methods, templates, general know-how, and reusable implementation patterns.
9. Cancellation, renewal, and refunds
The proposal states the pilot end date, any ongoing management arrangement, notice period, renewal, and cancellation terms. If the parties continue after the pilot, the next scope and fee are agreed in writing. Completed setup, management time, approved third-party charges, and delivered work are not refundable unless the proposal says otherwise. If NexFlowsTech cannot deliver an agreed item due to its own fault, the parties will first agree on a reasonable correction, revised scope, or refund for the undelivered portion.
10. Liability
To the extent permitted by law, NexFlowsTech is not liable for indirect losses, lost profit, business interruption, platform outages, or decisions made by the client or a third party. Liability for a specific service is limited to the amount paid for that service, except where applicable law does not permit that limitation.
11. Governing law and contact
These terms are governed by the laws of Malaysia. Questions about the service or an agreed proposal can be sent to customer@nexflowstech.com.
